The Failure of the 28-Clause Peace Proposal for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe experienced widespread relief on Monday, as the diplomatic emergency triggered by the introduction of a new 28-point plan for ending the war appeared – momentarily – to have been stabilised. A senior US official spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Moscow made its countermove: an extensive attack of aerial bombardment on Kyiv.

The Rhythm of Negotiation and Warfare

The sequence of opposing developments captured the harsh reality of the current period. By day, negotiation efforts are fought: positive announcements are delivered from multiple capitals. Significant resources is devoted on managing specific proposals. By night, Moscow brutally reminds the world that, for them, war remains the main instrument for achieving "peace".

Nighttime Reality

As Russia's attack progressed into the early hours of Tuesday, the current condition of Ukraine's exposure was laid bare. Ukraine is capable of detecting missile launches from Russian territory, a capacity enabled by up-to-date information. From vantage locations, defense planes that had been scrambled to counter approaching cruise missiles flew past – modern combat jets provided to Ukraine by European allies.

Shortly after, Kyiv's anti-aircraft weapons engaged: multiple launches targeted at a hostile projectile. This was a modern interception technology at work, most likely provided by partner states. Every launch creates sudden vibrations, causing tremors. The instant of fear quickly becomes grim resignation: maybe the hostile projectile won't cause damage this time, preventing destruction from catastrophe and additional electricity failures.

Ongoing Risks

Soon after, a large-caliber weapon opened up on a drone in the vicinity, part of a mobile-fire group – probably allied-provided weaponry. Sadly, the shots failed to hit the hostile drone – it maintained course toward its objective.

With pauses, this persisted until dawn. Kyiv awoke to the daybreak reports: seven people killed, devastation and heating outages in numerous residences as a result of the night's assault. As customarily, everyone still went about their day – living the war. But those full day demonstrated Ukraine's essential dependence on external assistance – a dependence that neighboring countries are demonstrably unable to substitute in the short term.

Ineffective Peace Efforts

The comprehensive proposal from US administration sparked intense emotion, debate and serious worry – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and bilateral conferences.

Every new initiative from Washington unfolds according to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They stabilise the situation but never actually win the battle. This pattern will, no doubt, endure.

Tactical Assessments

It is tempting to accuse certain parties of consistently pushing Kremlin's demands. But that does not seem to be the whole story. US administration works based on a principle well known to seasoned negotiators: you cannot secure via talks what you have failed to defend militarily. The American government presumes that it is unfeasible to pressure the Kremlin to relinquish the land that it already controls in Ukraine's south or east.

The challenge is that while recognising this factual reality, US leadership does little to deter Moscow, through diplomacy or military means, from assuming that the current condition will not evolve additionally in its favour in the coming year.

Opposing Positions

Therefore, Russian leadership is confident that duration works to their advantage – that Ukraine and its supporters are coming close to fatigue. Their reason to sign a deal that does not give them the largest achievable advantage is almost completely absent. There may be multiple initiatives to end hostilities, but they will carry on as long as Russia's government remains completely certain in the result.

On the contrary, Kyiv believes that Ukraine can still endure, progressively conceding lives and land but preventing a complete military breakdown until conditions improve in its favour.

Existing Situation

Factually, there are no actual prerequisites for a armistice. Now, subjective factors are coming into play: personal goals to broker a ceasefire and achieve global acclaim, and Kyiv's dual difficulties – on one hand, not to distance important partners, and on the other, to mobilize citizens around the flag against any initiative Kyiv finds unworkable, so that their attention does not shift toward homefront challenges. And although their task will now be considerably more difficult after current events, it remains quite doubtful that this will modify their basic position.

These two forces are driving the talks.

Summary and Prospects

It took a only one week to terminate the suggested clauses of the current initiative. Aggressive and erratic handling of the matter by US administration, pushback by Ukraine and the other European countries, along with soothing efforts of negotiators, and finally, latest revelations, all achieved their purpose.

While new plans based on established approaches are imminent, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to resist political attacks from Washington that are rooted in Kremlin requirements and reflect certain reluctance to modify developments, if they remain united and strengthen their defence capabilities at a much faster pace. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the coming months, largely rely on ongoing international assistance.
